CLAIM POLICY

Although we do try to make the product exactly as per the customer’s specifications and to the best of the quality, there are some times when mistakes occur owing to the nature of the industry and for the fact that the product depends on the skill of the labours and understanding of client’s requirements.
We do appreciate that at your end you have to come up to the exacting standards of your clients. In doing so, you may have to some time give him a quick solution or even an instant claim or credit. This is basically a business risk which is an inherent risk of the distribution business in the Western world. We would like to stand behind our product, however, we would need to do so within the following parameters :-
1. In case of any defect arising out of a reason in the bag which was clearly mentioned in the specification and on which there was no misunderstanding or if there is a mistake by our workers in such a manner that the specification was not followed or if there is a failure of a bag on account of poor workmanship we would be liable to pay the claim on the bag. The claim would be calculated on the following basis:-

a) The claim will be restricted to the quantity of the bags found defective.

b) You would first try to get the mistake rectified locally the cost of which would be borne by us subject to that the cost of such repair does not exceed more than 50% of the f.o.b. value of the bag.

c) In case the cost of repair goes beyond the above limit we would need to get the bags shipped to India for repair and we would repair the bags and send it back to you.

d) The incidental costs involved in collecting or segregating bags or any other cost at your client’s end will not be borne by us.

e) We will not be liable topay any claim for any late deliveries which might happen due to infrastructural delays or delays on account of shipping companies. Furthermore, normal delay of upto 2 weeks in our factory would also not be liable for any claim.

f) Any delay in delivery due to non-clarity in specifications / printing or any other clarification sought and not received in time would not be liable for any claims.

g) We would not be liable for any claims on account of risk purchases done by you for delays in delivery or quality reasons.

h) We would not be liable for any third-party claims raised by your clients on you for whatsoever reasons. Thus, we would not be liable for any consequential losses arising out of our supplies to you or to your client.

i) In case a bag is unusable by the client for a reason which is our fault and is accepted by us we would need to sell the bags to some other party and in such a case we would be liable to a claim of upto maximum 25% of the f.o.b. value of the bag (i.e. the difference between bag cost and salvage value).

j) In certain situations for an instant solution or to keep the client, the bag may have to be air-freighted. In such a situation we may agree to air-freight the bags depending on the situation, however, the cost of the air-freight will have to be borne by you.

k) In case of minor issues in the bag which should have resulted due to confusions in the specifications or the language, no claim will be entertained.
